אפליקציית תיאוריה (Theory Test Israel) · בתוקף מ-13 ביוני 2026

תקנון זה מסדיר את השימוש באפליקציית תיאוריה, המופעלת על ידי בן באשא ("אנחנו"). התקנת האפליקציה או שימוש בה מהווים הסכמה לתקנון. יצירת קשר: theory@benbasha.com.

1. מה האפליקציה

האפליקציה היא כלי לימוד למבחן התיאוריה בישראל. היא כוללת את מאגר שאלות התיאוריה הרשמי שמפרסם משרד התחבורה ב-gov.il, יחד עם הסברים, מצבי תרגול, סימולציית מבחן ומעקב התקדמות.

2. רישיון שימוש

אנחנו מעניקים לכם רישיון אישי, לא בלעדי ולא ניתן להעברה, להשתמש באפליקציה במכשירים שבבעלותכם, לצורך ההכנה שלכם למבחן. אסור להעתיק, לשנות, להפיץ, למכור, להשכיר או לבצע הנדסה לאחור של האפליקציה או לחלץ את קוד המקור שלה, אלא במידה שהדין מתיר זאת על אף תנאים אלה.

3. לא רשמי, ואין הבטחה לעבור

• מאגר השאלות מבוסס על המאגר הציבורי הרשמי ב-gov.il, אך אנחנו לא קשורים למשרד התחבורה, והאפליקציה אינה מטעמו ואינה מאושרת על ידו או על ידי כל גוף ממשלתי אחר.
• משרד התחבורה רשאי לשנות את המאגר הרשמי או את מתכונת המבחן בכל עת; ייתכן שתוכן האפליקציה יתעדכן באיחור.
• ההסברים, מד המוכנות וכל ציון הם כלי עזר לימודיים בלבד. השימוש באפליקציה אינו מבטיח מעבר של מבחן התיאוריה, והאפליקציה אינה תחליף לחומרי הלימוד הרשמיים או להוראת נהיגה מקצועית.

4. הגרסה החינמית ופרסומות

הגרסה החינמית כוללת מגבלות שימוש יומיות ומציגה פרסומות (ראו במדיניות הפרטיות בכתובת theory.benbasha.com/privacy מה כרוך בהצגת פרסומות). אנחנו רשאים להתאים את מגבלות המסלול החינמי מעת לעת.

5. נתונים ואנליטיקה

תוכן הלמידה המפורט שלכם נשאר על המכשיר. כדי לשפר את האפליקציה אנחנו אוספים נתוני שימוש ודיווחי קריסות אנונימיים דרך Mixpanel ו-Google Firebase, והגרסה החינמית מציגה פרסומות דרך Google AdMob. שום דבר מזה אינו מזהה אתכם אישית — אין חשבונות, שמות או כתובות דוא"ל. מה נאסף, למה, ואילו אפשרויות יש לכם מתואר במדיניות הפרטיות בכתובת theory.benbasha.com/privacy. השימוש באפליקציה מהווה הסכמה לעיבוד כפי שמתואר שם.

6. הפתיחה המלאה (פרימיום)

• הפתיחה המלאה היא רכישה חד-פעמית בתוך האפליקציה — לא מנוי. היא מסירה את הפרסומות ומבטלת את מגבלות המסלול החינמי בחשבון חנות האפליקציות של המכשיר.
• החיוב מתבצע כולו על ידי ה-App Store של אפל או Google Play, בהתאם לתנאים שלהם. החזרים כספיים מטופלים על ידי החנות לפי מדיניות ההחזרים שלה; אין לנו אפשרות לבצע החזרים ישירות.
• לשחזור הרכישה במכשיר חדש שמחובר לאותו חשבון חנות, השתמשו ב"שחזור רכישה" בהגדרות.

7. שימוש הוגן

אתם מתחייבים שלא לעשות שימוש לרעה באפליקציה — ובכלל זה לא לנסות לעקוף את מגבלות המסלול החינמי או את אימות הרכישה, לא לגרד (scrape) או לארוז מחדש את התוכן המהודר של האפליקציה, ולא להשתמש באפליקציה בדרך בלתי חוקית.

8. הסרת אחריות

האפליקציה מסופקת "כפי שהיא" (AS IS) ובכפוף לזמינותה, ללא אחריות מכל סוג, מפורשת או משתמעת — לרבות בנוגע לדיוק, לשלמות, להתאמה למטרה מסוימת או לזמינות רציפה.

9. הגבלת אחריות

במידה המרבית המותרת בדין, לא נהיה אחראים לנזקים עקיפים, נלווים או תוצאתיים הנובעים מהשימוש באפליקציה — לרבות אי-מעבר של מבחן התיאוריה, עלויות מבחן חוזר או אובדן נתונים השמורים מקומית. סך אחריותנו לכל תביעה מוגבל לסכום ששילמתם עבור הפתיחה המלאה (או אפס אם אתם משתמשים בגרסה החינמית).

10. שינויים באפליקציה או בתקנון

אנחנו רשאים לעדכן, לשנות או להפסיק את האפליקציה או כל יכולת בה בכל עת. אם התקנון ישתנה באופן מהותי, הגרסה המעודכנת תפורסם בכתובת theory.benbasha.com/terms עם תאריך תוקף חדש; המשך שימוש לאחר שינוי מהווה הסכמה לתקנון המעודכן.

11. סיום

אפשר להפסיק להשתמש באפליקציה בכל עת על ידי מחיקתה. אנחנו רשאים להשעות את הרישיון של מי שמפר תקנון זה הפרה מהותית.

12. דין וסמכות שיפוט

על תקנון זה חלים דיני מדינת ישראל, ולבתי המשפט המוסמכים בישראל סמכות שיפוט בלעדית בכל מחלוקת הנובעת ממנו.

These terms govern your use of the תיאוריה (Theory Test Israel) mobile app, operated by Ben Basha ("we"). By installing or using the app you accept them. Contact: theory@benbasha.com.

1. What the app is

The app is a study tool for the Israeli driving-theory exam. It bundles the official driving-theory question bank published by the Israeli Ministry of Transport on gov.il, together with explanations, practice modes, an exam simulation, and progress tracking.

2. License to use

We grant you a personal, non-exclusive, non-transferable license to use the app on devices you own, for your own exam preparation. You may not copy, modify, distribute, sell, rent, or reverse-engineer the app or extract its source code, except where the law allows it despite these terms.

3. Not official, no guarantee of passing

• The question bank is sourced from the official public bank on gov.il, but we are not affiliated with, and the app is not endorsed by, the Israeli Ministry of Transport or any government body.
• The Ministry may change the official bank or the exam format at any time; the app's content may lag behind such changes.
• Explanations, the readiness meter, and any scores are study aids only. Using the app does not guarantee passing the theory exam, and the app is not a substitute for official study materials or professional driving instruction.

4. Free version and ads

The free version includes daily usage limits and shows ads (see the privacy policy at theory.benbasha.com/privacy for what ad serving involves). We may adjust the free tier's limits over time.

5. Data and analytics

Your detailed learning content stays on your device. To improve the app, we collect anonymous usage analytics and crash reports through Mixpanel and Google Firebase, and the free version shows ads through Google AdMob. None of this identifies you personally — there are no accounts, names, or emails. What is collected, why, and the choices you have are described in the privacy policy at theory.benbasha.com/privacy. By using the app you agree to that processing as described there.

6. Premium unlock

• The premium unlock is a one-time, non-consumable in-app purchase — not a subscription. It removes ads and lifts the free tier's limits on the device's app-store account.
• Billing is handled entirely by Apple's App Store or Google Play under their terms. Refunds are handled by the store under the store's refund policy; we cannot issue refunds directly.
• Use "Restore purchase" in settings to recover the unlock on a new device signed into the same store account.

7. Acceptable use

You agree not to misuse the app — including attempting to bypass the free tier's limits or purchase verification, scraping or repackaging the app's compiled content, or using the app in any unlawful way.

8. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, express or implied — including accuracy, completeness, fitness for a particular purpose, or uninterrupted availability.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from use of the app — including failing the theory exam, costs of re-taking it, or loss of locally stored data. Our total liability for any claim is limited to the amount you paid for the premium unlock (or zero if you use the free version).

10. Changes to the app or these terms

We may update, change, or discontinue the app or any feature at any time. If these terms change materially, the updated version will be posted at theory.benbasha.com/terms with a new effective date; continued use after a change means you accept the updated terms.

11. Termination

You may stop using the app at any time by deleting it. We may suspend the license of anyone who materially breaches these terms.

12. Governing law

These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction over any dispute arising from them.
